Two of Bryan Nelson’s attorneys recently won their client $368,000.00 for damages that occurred while the client accidentally fell into an unprotected hole that served as an oil pit.

James Savage, plaintiff, worked as a delivery driver for ProBuild, a contractor’s yard similar to Lowe’s, where contractors buy lumber and other construction materials. On May 14, 2013, Savage was making a delivery to Fairley Construction Services in Stone County. Savage entered the half built building where he saw plywood covering the floor and blocking his way. Savage moved the plywood out of his way and did not realize the wood was covering an oil change pit.

Savage fell into the pit, and as a result sustained a ruptured spleen. His medical bills were $109,582.00 and his lost wages totaled at $4,745.00.

The case ended with a mixed verdict from the jury, which assigned 80% fault to Fairley Construction 20% fault to Savage, with total damages of $460,000. The net award to Savage was 80% of the total, $368,000.00.

Mark E. Norton- Underinsured Motorist

A Stone County jury recently returned a verdict in favor of a Bryan Nelson client. Bryan Nelson Attorney, Mark E. Norton, defended a case involving an underinsured motorist who complained of soft-tissue symptoms after getting rear-ended.

On January 18, 2017, a jury heard arguments pertaining to a car accident that occurred in 2014. Though instructed to find for the plaintiff, the jury awarded the exact amount of damages suggested by the Defendant.

Plaintiff Dianne Haas, 69, was stopped in traffic on August 15, 2014 in Wiggins. Tortfeaser, Jeffrey Musgrave who was behind her in traffic, looked down for a brief moment, and by the time he looked back up, there was no time for him to stop. Musgrave rear-ended Haas, and the impact knocked her into the next car with a moderate impact.

Haas was taken to a local ER by ambulance where she was treated for soft-tissue symptoms as well as treated by a chiropractor for over a year. Her medical bills were a total of $14,887. Haas had already received $25,000 from the tortfeasor, but the jury was not told of this.

Haas asked for a $50,000 award and the defense suggested the medical bills (after the total was conceded as reasonable) plus $6,500 more for pain and suffering for a total of $21,500.

The jury returned a general verdict for Hass in the sum of $21,500, however, it was less than the floor of UIM coverage and a defense judgment was entered for Liberty Mutual.

Norton has represented clients for Bryan Nelson since 2005. In addition to automobile litigation, he also practices in general litigation, estates, and construction.
